Ultimate Myrtle Beach Road Trip Sweepstakes Contest Rules:
1.) Eligibility: No purchase is necessary to enter or claim prize. The Ultimate Myrtle Beach Road Trip Sweepstakes (the "Sweepstakes") is open to all legal U.S. residents and Canadian Residents (except Quebec) who are at least 18 years of age, except employees of Myrtle Beach Golf Holiday ("Sponsor"), and their affiliates, partners, subsidiaries, franchises, distributors, retailers, advertising and promotion agencies, and the immediate families or household members of each. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void where prohibited by law or regulations.2.) How to enter: To enter, visit www.roadtriptomyrtle.com complete and submit the registration form located at the website. To be eligible for the Sweepstakes, online entries much be received between 12:00 p.m. Eastern Standard Time ("EST") on December 5, 2008 and 11:59:59 p.m. EST on July 1, 2009 (the "Sweepstakes Period"). Only one (1) entry per person/email address; entries with duplicate email addresses or multiple entries using different email addresses for a single individual will be disqualified. All entries and requests become the property of Sponsor and will not be acknowledged or returned. In the event of a dispute over the identity of an online entrant, entry will be deemed submitted by the authorized account holder of the e-mail account of the e-mail address submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider, or other organization (e.g. business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
3.) Prizes: (1) One winner will receive golf, accommodations, nightly dinners (one with Golf Channel star Charlie Rymer) and limo transportation, set of custom fitted golf clubs, half day instruction from Top 25 Teacher, and golf outfits for four (4) golfers in Myrtle Beach, SC during a scheduled visit between October 1, 2009 and December 31, 2010. Other gifts and prizes may be added to the prize package. Prize value: $11,800.
4.) Selection of winner: Winner will be determined by Myrtle Beach Golf Holiday on or about July 15, 2009 (from among eligible entries submitted during the Sweepstakes Period) conducted by representatives of Sponsor, who decisions are final and binding in all matters relations to this Sweepstakes. Winner will be notified by telephone, mail, or e-mail on or about July 15, 2009 and will be given instructions on how to claim prize. Winner will be required to sign and return an affidavit of eligibility and liability release (and, where permitted, publicity release) within five (5) days of notification or prize will be forfeited and awarded to an alternate winner. Odds of winning depend on the number of eligible entries received
5.) Release of Liability: By participating, you release Sponsor, and their subsidiaries, affiliates, partners, employees, directors, agents, advertising agencies, and all other associated with the development and execution of this Sweepstakes, from any and against any and all injury, loss or damage caused or claimed to be caused by your participation in the Sweepstakes and/or the acceptance, awarding, receipt, use and/or misuse of the prize, and you agree that these entities are in no matter responsible for any warranty, representation, or guarantee, expressed or implied, in fact or in law, relating to the promotion and/or the awarding of any prize. Notwithstanding the foregoing, in the event that the preceding release is determined by a court of competent jurisdiction to be invalid or void for any reason, the entrant agrees that, by entering the Sweepstakes, (i) any and all disputes, claims, and causes of action arising out of or in connection with the Sweepstakes, or any prizes awarded, shall be resolved individually without resort to any form of class action; (ii) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys fees; and (iii) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, incidental or consequential damages of any and all rights to have damages or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.
6.) Additional Rules: Entry materials/data that have been tampered with or altered, or mass entries or entries generated by a scrip, macro or use of automated devices are void. Sponsor is not responsible for: (i) lost, late, misdirected, damaged, garbled or illegible entries; (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmissions of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof; or (iii) any injury or damage to entrant’s or any other person’s computer related to or resulting from participating in the Sweepstakes. Sponsor is not responsible if planned golf rounds are rained out, postponed, or cancelled for any reason, in whole or in part. In that event, no compensation will be paid in lieu of the prize package. By participating in the Sweepstakes, you (i) agree to be bound by these official rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor, which are final and binding inn all matters relations to the Sweepstakes. Failure to comply with these official rules may result in disqualification from the Sweepstakes. Sponsor reserves the right to: (i) permanently disqualify from any sweepstakes it sponsors any person it believes has intentionally violated these official rules; and (ii) suspend, modify, or terminate the Sweepstakes if Sponsor believes, in its sole discretion that malfunction, error, disruption or damage, is impairing or will impair the administration, security, fairness, integrity, or proper play of the Sweepstakes. If Sweepstakes is terminated before the end date, Sponsor will determine the winner from all eligible entries received as of the termination date. Entry constitutes consent to the use of prize winners’ name, voice, picture, video, photograph submitted as party of entry Sweepstakes, and/or likeness without compensation for promotion purposes.
7.) Winners Name: For the name of the winner (available by August 15, 2009) send a stamped, self-addressed envelope (postage not required for Vermont residents) by October 1, 2009 to Myrtle Beach Golf Holiday, Attention: Jenna Hottel, 3420 Pampas Drive, Myrtle Beach, SC 29577.
